In fact, in 1992, the speed of broadband, as detailed in state laws, was 45 Mbps in both directions -- by 2014, all of us should have been enjoying gigabit speeds (1000 Mbps).
Fact is that we, as a nation, have paid these companies hundreds of billions of dollars for high speed internet access. Time and time again the phone companies have renege on what they promised to do since the 90's. If you're an American taxpayer, you personally have spent between $2000 and $6000 of your tax dollars for service you still won't get.
Honestly, I don't know if this will get any traction. Just because there's a law passed don't mean they're actually going to do anything about it in any meaningful timeframe.
I'm pretty confident that the evil marketing people will cheerfully circumvent this, just like every other marketing restriction they've come across. I still hear ads for "unlimited internet", when it's anything but.
