I agree. I don't like how the article has a "Diaz was completely innocent" feel to it. I'm not saying he deserved to be shot but it's not like he was a model citizen. Yes he was unarmed, but how did the officers know that? How did they know if he was reaching for something?
Its not like citizens are trained with people yelling and pointing guns at them. Maybe dude had no idea what they were yelling at him to do because he didn't speak the language. He was probably nervous as hell to boot.
Edit: You are saying the officers should not be punished for their overreaction because he took his hat off? I mean if you saying that and the officers should not be punished?
