Hardcore porn is prohibited in Britain too, but it's still being exported. Maybe someone at NYT needs to learn to compose headlines.
Having said that, the answer to the question is, as always, "because someone powerful is making money from it".
The obvious answer here is that the US FDA can be bought off or easily swayed because anything stopping a private business from doing whatever it wants is a harm to the free market system.
