You can't win against repeated, unlimited attempts by your government to do the bidding of the corporations who own them. No matter how many times you "win", they will continue trying, and they have unlimited money and resources.
The only way I see this resolving itself is by the Internet going the way of the TV, and then something else coming up to replace it. Then there will be some years of fair use of that new medium until the vultures lay eyes on it.
