In the US (I'm not sure about if the UK has similar issues..) I would have to think that the RIAA and the MPAA screaming for their 'fair share' from all the pirating (and even the personal use abuse) cases has some sort of influence cases like this. And I don't disagree, in most cases, the judges simply aren't up to speed on the tech.
