Fortunately, US Intel officials don't have the last say on interpreting things like laws and the constitution. We have judges for that.

Exactly. Anyone who is still believing in the separation of powers and in constitutional rights has been living under a rock or is willingly delusional. We're in what's possibly the most sophisticated authoritarian regime in history, and it's only going to get worse.
It would be interesting to have an AI deep dive into this question. it may be that there is a new set of legal parameters...and it may require robotic (AI) solutions to enforce.
