The story adds a lot of emotional elements, specifically, "They picked out their wedding bands the day before the murder.". While all of this is very sad, and brings to light two sick people who would do such things to another human (alive or dead), the real judgment should be based on the law. Now that it is known he did not rape her, should he still get the death penalty?
Judging by the manner in which he killed the young woman, and the fact that he is a repeat offender, I think he should. Not that I believe in the death penalty in general (if anything this should show you its faults, consider if the mere existence of semen implicated he murdered her as well), but I do not think this should make the crime any less horrible. The way she was murdered should be enough to justify his sentence.
