Indiana man files suit for right to give the finger to state trooper
An Indiana man is contending in a federal lawsuit that his right to free speech was violated after he was ticketed for showing a state trooper his middle finger. The Tribune Star of Terre Haute reports that Mark May is seeking unspecified damages against Indiana State Police Master Trooper Matt Ames.

Can't find the links right off hand, but I believe the 5th, 9th, and the 11th have also affirmed it's protected by the First Amendment. No circuit has ruled that it isn't legal.
Looks like the 7th is about to join the "contempt of cop isn't a crime" club.
