That dissenting judge is a fricking clown, Apple opened the market up to be more competitive from a monopolist my foot. My ebooks some of which used to be 6.99 to 7.99 up to 9.99 were suddenly 9.99 to 14.99 and some of them were higher than that and priced like hard backs for a while. Apple absolutely colluded and bribed its way to a better deal and higher prices with the publishers, the publishers just had the good sense to change their position and admit it and take a fine rather than court.
Amazon had a monopoly only because they were the only game in town, Apple could have used the same methods as Amazon of buying bulk licenses and selling them at a loss or profit if they wanted to, instead Apple chose to collude and raise prices and give Publishers a big cut of the profit to kill off the ability to license in bulk and charge whatever.
