The whole forced refund thing does seem rather extreme and hopefully the scare of this happening to all Kickstarter backers isn't accurate. It's sad to see so much uncertainty & drama around such a big crowdfunded project, hopefully this all ends well and not in a big ball of fire.
The key takeaway from this is that Derek Smart is a moron and you should never, ever listen to a word he says. He's been trolling game development discussions for years upon years, while occasionally releasing some miserable excuse of a game so that he gets to pretend to be an "expert" on the subject.
