This is also a feature on the PS4. I was playing 2k14 while talking with a friend on party chat, then I got flagged for a technical foul for swearing. At least the Playstation will only pick up on it when you have a mic plugged in
Stupid feature but at least you can unplug the mic. Xbox is always on which is lame.
