Wanting A Trial By Jury Is Not A Crime. So Why Do We Treat It Like One?
There’s quite a bit of headshaking in the criminal justice community over insider trader Matthew Martoma’s decision to go to trial, rather than take a plea deal, and the sentence of nine years he received following his conviction. Martoma’s decision should not distract us from one deplorable feature of federal criminal sentencing: the trial penalty.
