Instagram Food Porn Violates Copyright Law Says German Court
In this food porn-loving day and age — there are now TV shows and dinners built around the concept — Instagramming a meal is pretty much an expected step when dining out: Sit down at restaurant, order food, Instagram said food, pay check, leave. Unfortunately, what is now second nature to many diners may get them into legal trouble in Germany.

As the article points out, enforcing this rule across the board would be a poor business decision. Great "food porn" shots (hate the term) are a form of advertisement for your business. In practice, I'm sure this will be used strictly in cases where someone profits in some way from using some food picture that's based on someone else's work.
Doesn't make as appealing a headline as to threaten the whole of Instagram with the death of foodie pictures, though.
