    Are you going to be buying or selling a home? If so, it's quite possible that you will hear about the term "dual agency". Dual agency can have a few meanings. For purposes of this discussion I am talking about when one agent represents both the buyer and seller in a real estate transaction.

    Let me make one thing perfectly clear - it is impossible to "represent" both parties who have differing goals in a real estate transaction. When you allow dual agency, YOU'RE real estate agent becomes a neutral party. They no longer represent your interests exclusively anymore.

    What this means in the real world is that they are not allowed to give you any guidance. They essentially become a middle man. If you are buying or selling, in no uncertain terms should you allow your real estate agent to practice dual agency.

    Be aware as well that many unethical agents will explain dual agency away as not being so bad. The problem is they have a vested interest in you believe that. Frankly, it is hog wash.

    Quite a few states have banned the practice of dual agency. You can see which ones have in the reference above. Just because something is legal doesn't mean it is right. Dual agency in Massachusetts is still legal. If wish they would ban it because the practice hurts consumers. Do yourself a favor and just say NO!
